Bidders should note that one site included in this RFP is not E-Rate eligible, as it is for pre-k students which are not eligible for funding in Ohio. That site is part of this procurement so vendors understand the full scope of work, but the District will not request E-Rate support for it and will pay its full cost. Because of this, the number of sites in the RFP is greater than the number of entities listed on the Form 470 in EPC. Bidders must price the ineligible site separately in their responses so the District can remove its cost from any funding request, as detailed in the RFP. The District will follow all applicable Ohio procurement laws and District Board of Education purchasing policies, including Ohio Revised Code (ORC) 3313.46 where applicable, together with all FCC E-Rate competitive bidding rules. Where state or local requirements differ from FCC rules, the more restrictive requirement will apply. Under ORC 9.24, the District will not award a contract to any bidder with an unresolved finding for recovery issued by the Auditor of State. Bid evaluation will treat price of eligible goods and services as the primary factor, as required by FCC rules.
